A local-business platform, not an unrestricted posting service
Marketing-Ad.com exists to support legitimate businesses and useful local discovery. Access to business tools and public publishing is conditioned on compliance with these Terms and the platform's eligibility, verification, moderation and safety requirements.
1. Acceptance and authority
By creating an account, editing a business, submitting content, using business tools, publishing material, requesting services or otherwise using Marketing-Ad.com, you agree to these Terms and the Privacy Policy.
If you act for a business or organization, you represent that you are authorized to act for it. A person may not claim, edit or operate a business account by impersonation or without appropriate authority.
2. Business eligibility
Marketing-Ad.com is intended for legitimate businesses that are located in, regularly serve, or have a genuine commercial connection to the Marketing-Ad area. We may request or review information reasonably related to identity, ownership or authorization, business contact information, address or service area, category, website, public business presence, licensing where relevant, or other indicators of legitimacy.
A ZIP code, address or automated match may help with verification but does not by itself create a right to public listing or continued access.
3. Business approval and public publishing
New businesses may be allowed to build privately while their account remains pending. Pending businesses may prepare business information, media and marketing drafts, but public publishing may be blocked until the business is approved.
Approval is a business-level permission to use public publishing tools. Approval does not automatically publish any draft, promotion or offer; the business owner remains responsible for choosing what to publish.
Approval may be withheld, delayed, reconsidered, suspended or revoked if information is incomplete, inaccurate, misleading, unverifiable, abusive, inconsistent with the purpose of the platform, or presents a material trust, safety, legal or security concern.
4. Suspension, removal and permanent blocking
To protect legitimate businesses, customers and the integrity of Marketing-Ad.com, SurfLocal Media LLC may suspend, restrict, reject, unpublish, remove or permanently block an account, business page, promotion, submission or user when we reasonably determine that the account or activity involves misuse, fraud, deception, impersonation, spam, harassment, malicious conduct, repeated policy violations, attempted circumvention, legal risk, security risk, or material harm to the platform or its users.
Serious or repeated violations may result in permanent loss of access. Creating new accounts, changing contact information, using another person's account, or otherwise attempting to evade a suspension or permanent block is prohibited and may result in immediate removal of related accounts, content or access.
Where practical, we may provide notice or an opportunity to correct a problem. However, we may act without prior notice when immediate action is reasonably necessary to address fraud, security, abuse, harmful conduct, legal exposure or platform integrity.
Nothing in these Terms requires Marketing-Ad.com to continue hosting a business, user or submission that no longer meets platform requirements or creates an unreasonable risk to other users or legitimate businesses.
5. Prohibited conduct
You may not use Marketing-Ad.com to:
- Create fake, deceptive, duplicate, misleading or impersonating business accounts.
- Misrepresent a business location, service area, ownership, affiliation, qualifications, licensing, pricing, offer, availability or relationship with another organization.
- Publish scams, fraudulent offers, deceptive claims, malware, malicious links, phishing material or intentionally misleading redirects.
- Harass, threaten, stalk, exploit or unlawfully discriminate against another person.
- Publish unlawful, infringing, defamatory, obscene or intentionally harmful content.
- Scrape or harvest data excessively, probe security, bypass access controls, interfere with service operation, or attempt unauthorized access.
- Use bots, scripts or automated registrations to create accounts, publish content or bypass platform controls without written authorization.
- Evade moderation, suspension, deletion, rate limits, verification requirements or a permanent block.
- Use customer leads, bookings or contact information for unrelated spam, resale, harassment, unlawful solicitation or other unauthorized purposes.
- Interfere with, intimidate or retaliate against a legitimate business or user for reporting suspected abuse or policy violations.
6. Accurate listings, offers and business content
Business owners are responsible for keeping the information, services, hours, prices, qualifications, offers, promotions and claims they publish accurate, current and lawful.
You represent that you have the rights and permissions necessary for photos, logos, text and other content you submit. You may not knowingly publish content that infringes another person's copyright, trademark, privacy, publicity or other legal rights.
You retain ownership of your content. You grant SurfLocal Media LLC and Marketing-Ad.com a non-exclusive, worldwide, royalty-free license to host, store, reproduce, format, display and distribute submitted content as reasonably necessary to operate, promote and provide the Marketing-Ad.com service and the business presence you requested.
7. Moderation and publication decisions
Drafting or submitting content does not guarantee publication. Marketing-Ad.com may review, reject, unpublish, reclassify, restrict or remove content that violates these Terms, creates a trust or safety concern, is materially inaccurate, or does not fit the purpose of the local-business platform.
We do not guarantee any particular placement, ranking, visibility, traffic level or duration of publication.
8. Google matching and third-party services
Connecting or matching a listing to a Google Place ID does not transfer ownership of a Google Business Profile and does not imply endorsement by Google.
Optional features may use third-party services including Google Maps Platform and OpenAI. Use of Google Maps Platform content is also subject to the Google Maps Platform Terms of Service. Other connected services may have separate terms, privacy policies, fees or availability.
9. AI-assisted content
AI features may help draft descriptions, marketing, offers or other material. AI output is provided for review and may be incomplete or inaccurate. Business owners are responsible for reviewing and approving the factual accuracy, legality and appropriateness of content they choose to use or publish.
10. Customer leads, bookings and communications
If a business receives customer inquiries, booking requests, contact information or other customer data through Marketing-Ad.com, the business must use that information responsibly, lawfully and in connection with the customer's request or legitimate business relationship.
Businesses are responsible for complying with applicable privacy, advertising, telemarketing, email, SMS, consumer-protection and industry-specific requirements that apply to their own communications and services.
11. Marketing-Ad.com SMS Terms
Marketing-Ad.com sends customer-care SMS only to users who voluntarily opt in while submitting a request through Marketing-Ad.com. Messages may acknowledge a request, answer a question, coordinate a requested service or appointment, or provide a requested status update.
Message frequency varies. Message and data rates may apply. SMS consent is optional and is not a condition of purchase.
Reply STOP to opt out at any time. Reply HELP for help. You may also contact contact@marketing-ad.com. See the Privacy Policy for information about mobile-data handling.
12. Free platform and optional paid services
The core Marketing-Ad.com platform may be offered free to qualifying or approved businesses. Optional services—such as professional setup assistance, business phone, SMS, AI answering, advanced marketing or other connected services—may carry separate charges.
A displayed price applies only to the identified optional service. Paying for an optional service does not guarantee approval, public ranking, customer leads, sales or any particular business result.
13. No guarantee of results
Marketing-Ad.com provides tools and opportunities for local visibility, business information, promotions, discovery, lead capture and related activity. We do not guarantee search-engine rankings, traffic, customer leads, sales, bookings, revenue, reviews, phone calls, campaign performance or any other business result.
14. Service availability and changes
We may add, change, suspend, limit or discontinue features, listings, integrations or parts of the service as reasonably necessary for security, accuracy, performance, maintenance, legal compliance, abuse prevention or usability.
We may also revise eligibility requirements, moderation standards or service features over time.
15. Disclaimer of warranties
To the maximum extent permitted by law, Marketing-Ad.com and its services are provided on an “as is” and “as available” basis. SurfLocal Media LLC does not warrant that the service will be uninterrupted, error-free, secure, or suitable for every business purpose.
16. Limitation of liability
To the maximum extent permitted by applicable law, SurfLocal Media LLC, Marketing-Ad.com, their affiliates and service providers will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost business opportunities, lost data, reputational harm or losses arising from third-party conduct.
Nothing in these Terms excludes liability that cannot lawfully be excluded.
17. Indemnity
To the extent permitted by law, you agree to defend, indemnify and hold harmless SurfLocal Media LLC, Marketing-Ad.com and their affiliates from claims, liabilities, damages, losses and reasonable costs arising from your content, your business activity, your violation of these Terms, your misuse of customer information, or your infringement of another person's rights.
18. Account closure, deletion and retained enforcement records
Businesses may request account closure or deletion through available procedures. Marketing-Ad.com may also remove a public business presence or close an account as permitted by these Terms.
We may retain limited records reasonably necessary for fraud prevention, abuse prevention, backup integrity, accounting, dispute resolution, legal compliance or enforcement of a suspension or permanent block.
19. Reporting abuse
If you believe a business, account, promotion or user is fraudulent, abusive, misleading or otherwise violating these Terms, please report it. We may investigate and take action we reasonably consider appropriate.
20. Governing law
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles, except where applicable law requires otherwise.
21. Changes to these Terms
We may update these Terms as the platform, connected services or legal requirements change. The effective date above identifies the current version. Continued use of Marketing-Ad.com after updated Terms become effective constitutes acceptance to the extent permitted by law.
22. Contact
Questions about these Terms may be sent to contact@marketing-ad.com or by calling 806-484-1155.
